(Before Mr Justice Conolly.)
Charge of Theft.—Two young men named William John Mckenzie and Robert Foy pleaded not guilty to the charge of having stolen from the Hukerenui Hotel a cash-box containing a sum of ..money.. Mr J. A .Tole conducted the prosecution. The prisoners were undefended. A number of witnesses from Hukerenui, Kamo. and Whangarei were examined, and the. proceedings occupied all the forenoon and part of the afternoon.
His Honor said ,he would have to direct the jury that there was no evidence against Foy, though there was a good deal of suspicion. If it had been a charge of receiving against Foy it would be a different thing; and a charge of receiving stolen property could still be preferred against him. He directed the jury to aoquit Foy. The jury accordingly returned a verdict of "Not Guilty' against Foy, who was therefore discharged. The prisoner Mackenzie then called a witness, Ecbert Whitelaw, for the defence.
