ALLEGED THEFT OF SPECIMENS.
At the Coromandel Court- on Oct. 20, William O'Brien was charged that he did steal on the 19th Afay, 16th June, 23rd June, 7th July, and 29th September, gold-bearing quartz, the property of persons unknoAvn. Detective Herbert appeared for the prosecution, and Mr Ngata (Devore ; and Cooper) for the defence. I Detective Plerbert stated briefly that the accused took quartz for treatment to Eraser's Bbattery in Auckland on the dates mentioned, stating that they ODtained it from the 'Alary' claim, Kennedy's Bay, at Avhich time accused was in the Kapanga tribute. Henry Battens, mine manager of the Kapanga Company, anc! Captain Hodge, general manager gave evidence regarding the tribute. They identified the specimens produced as similar to the Kapanga stone. Air Lawlor, Alining Registrar, deposed that no 'Alary' claim was on the register in the Coromandel district. Air AlackloAV deposed that he was j a saAvmiller and oAvner of scows. Accused shoAved him specimens similar to those produced, and Avanted a scoyv to take thirty tons to Auckland from Kennedy's Bay in Afay last. Afr John Fraser, an employee of Fraser and Sons, said he lrneAv the accused under the name of Robert Bryan. The firm treated parcels of ore on the dates mentioned, the total value of the gold treated Avas £ 439 \ 3/6. Charles Williams, amalgamator for Fraser and Sons, and Charles Gribble, bullion clerk in the Bank of NeAv Zealand, gave corroborative evidence. Air A. Kenrick, manager of the Bank of New Zealand, also gave evidence. Accused aa'as committed for trial.
