ALLEGED ASSAULT AND ROBBERY.

To-day at the Magistrate's Court before Mr H. VV. Northerofb, S.M., the further hearing of tha charge of alleged assault and stealing the sum of 18e 6d from the person of Win. Roberts, on the 26th September, preferred against George Lawson and James Thompson was continued. Detective Chrystat deposed to seoing the accused at the corner of Darby-street about 11.30 on the night of the 26th September, and detailed a conversation ho had with accused. Lawaon eaicj "we would clear out of the blooming place if we could only raise the wind." At about. 12 noon on Saturday lasc witness was at the corner of the Waitemata Hotel. He saw the prosecutor Roberts in conversation with the accused Thompson. He went up to them, and Roberta at once said, "this is one of the men" (pointing to Thompson), "that knocked roe down and robbed me on Wednesday nighti" He arrested the. accused Thompson on Saturday. Rose Fricker. a single woman, living in Dnrham-sfcreeb, remembered the. nighb ot the 26bh of September. Mrs Sullivan was in witness's house. About half - past ten she beard a man screaming out If Murder." She ran out and saw a man1 lying on the ground, and two men running away. Witness ran. acroes the road and recognised two young fellows, one of whom had on a lighb coat. She recognised the accused, Thompson, but could nob swear to the other.

Dr. Makgill, House. Surgeon at the Hospital, deposed as to the nature of the injuries to Roberts. For the defence. Constable Lowry stated that on the night in question he ' had oceaaion to speak to Lawson,at about halfpast ten. This was inside the coffee stall afa the corner or Queen and Welloaleystreets., •■

William John Bull,l pork butcher, deposed that Lawson came into his shop on the nighb in .question, and bought eomo brawn. He thought this was about IS or 20 minutes to 11.

Lawson addressed the Bench, add said he was perfectly innocent of the charge. 'Lawson was discharged. Thompson was committed to take his trial at. the next criminal sittings of the Supreme Court.
