A BROKEN LEG.

At the Police Court yesterday afternoon, before Mr H. W. Bishop, K.M., the hearing of the charge of serious assault laid by Josiiih Mallet, of Newton, against James Colby, was continued. The assault in question resulted in the breaking of Mallet's leg. Mr Napier appeared for the defendant. Mrs Mallet, wife of the prosecutor, gave evidence corroborating that given by her husband. Robert McMillan, tailor's assistant, also gave evidence as to the assault. Constable Thomas Rnspell deposed to finding Mallet lying an the road, and to sending for a doctor and assisting him to set the limb. James Colby gave evidence in his defence, lie stated that he did not annoy prosecutor, but that the latter struck him one night in Pitt-street, and witness struck back in self-defence. JHe did not kick prosecutor. The Resident Magistrate said that there were inconsistencies in the evidence on both side?, and there was nvjch doubt as to whether the man's leg had been broken by a kick. Still, there had been an assault committed, but he would deal with it summarily. He lined the defendant £10, to include" costs, halt to be paid to the prosecutor : in default, two months' imprisonment with hard labour.
