"PICTURESQUE ATLAS."
DECISIONS AT INVEKCARGILL.

Invercargill, this day. Bowerman Bros, are proceeding against the subscribers to the " Picturesque Atlas," with varying succese. D. Strang, a wellknown cofl'ee merchant, resisted payment because the books were not delivered, and succeeded, the plaintiff being cast in costs. It appeared that the books were left in the entrance to Strang's office by Bowerman and disappeared. Yesterday the firm sued John Scott. He declared that he never signed any order for the books; that canvasser Metcalf, he believed, showed him pictures of Australia ; that he said he had no interest in the other colonies, though he might take a similar work on New Zealand if published; that Metcalf stated that that was his own feeling, and that he was trying to get support ior such a work, and asked Scott to sign a list of patrons, which he did. Scott declared trtiat the list produced was not the same, and described the difference. He alao affirmed, that he never signed any order. A bank official deposed that to the best of his belief the signatures were Scott's. Mr Rawson, R.M., gave judgment for the defendant, on the ground that he had been fraudulently induced to sign an .order for the '? : Picturesque Atlas" of Australia, at the time believing he was signing a patrons' list for a similar work referring to New Zealand, and that the canvasser represented that Scott would have an opportunity to inspect the work before subscribing for it. Leave to appeal was refused, on the ground that the decision was on a matter of fact.
