INTERESTING PIANO CASE
DAMAGES CLAIMED FOR TRES PASS.
TnE President Magistrate was again occupied to-day with a claim for £100 damages for alleged trespass and illegal seizure of a piano, brought by George Judd against A. Perkins and T. A; Ashton. Mr H. Williamson appeared for bhe plainbilf, and Mr Burton for the defence. Ib appeared from the evidence adduced bhab the Judds formerly resided ab Hamilton, and 'that there stayed with them for some years aMr Joseph Frear. Frear purchased a piano ab Hamilton, and took with him for that purpose Miss Judd to approve of the instrument. He paid for it by cheque for £52 10s, and had it sent to Mrs Judd's house. Subsequently the Judda removed to Newmarket, and on tho 21sb Augusb lasb the Mutual Creditors' Association, instructed by Mr Frear, took possession of the instrument, and had ib removed from Mrs Judd's residence. Mrs Judd protosted against the removal of tho piano on the ground that ib was given to her daughter by Freer, and subsequently proceedings wero taken to recover £100 damages from A. PcrkiDa and T. A. Ashton, who were acting on behalf of the Mutual Credibora' Association. The defence was thab Freer never made a prosenb of the piano to Miss Judd, and that there was no " trespass " by bhe defendanbs. Mrs Freer claimed to have paid Mr Freer £10 towards purchase of bhe insbrumenb; bub bhis was. denied by Mr Freer, and a good deal of contradictory evidence was given on this and other points. The evidence having been completed, tho case was adjourned till Thursday uexb, when His Worship will give judgmenb.
