Cooper, in support of tho application, said that Mr MacCormick had paid £12 on these terms: That Mr Blades would assent to the re-hoaring; that at tho re-hoaring no evidence would bo taken; that tho judgment already given would bo reversed, and then judgmont ontored for tlio defendant without costs.
