Drunk,—John Brown, 5,s and costs,

Larcknv.— Thos. (100, Gibson, Richard Lambert, and Philip Soumvays wore charged with breaking and entering the shop of llobort Melville on tho 10th inst.. and stealing "Jcwt. nails and a quantity of coppor therefrom, value £417s0d.—On the application of Sergeant White, the ase was remanded until Monday next.

FUKIOUS Dkivi.no. — Charles Connolly was charged with furious driving in Lower Chapel-stroot on the 28th of September.— On tho application of Mr Theo. Cooper, tho case was remanded untilto-morrow.

Ordek,—An order was made upon J. M. Nelson, who was called up to pay lus per week towards the maintenance of his wifo and child.—Mr Jackson for complainant, and Mr E. Cooper for defendant.

Alleged Fraud.—Augusto Knflin was charged with attempting to defraud his creditors by removing goods from his premises atNgunguru, in the northern part of tho province.—Mr Colcman appeared for the prosecution, and Mr Napier i»i defence. —David Oolwell, partner in tho firm of Mackie,' Logan nnd Co., deposed that he know tho accused. He is a debtor in .CIS 11s (id to tho firm for goods sold and delivered. On tho *?Sth September ho met Rnffin on board a steamer. Ho knew he was selling out of his business. Ho asked him if ho Was going to rocommence. Ho said ho was goin*; into his old business as cook at Whangarei. He said ho would call in tho afternoon at tho warehouse—he prosumed to pay tho account. Ife did not call) nor has ho settled. The next ho hoard was that prisonor had been arrested at New Plymouth, ho had sold his business, and the money had been paid over to him. —James B. Stoney, Clerk in tho Resident Magistrate's Court, produced tho summons, Hancock and Co. v. Kaflin, on which plaintiffs got a judgment on tlio 27th August for t'27 16s, costs I*6 12s. No money had been paid into Court in satisfaction.—Samuel .1 agger, of tho firm of Hancock and Co., brewers, of Newmarket, deposed that prisoner was a publican and storekeeper at Ngunguru. Ho was tho plaintiff in the suit referred to by Mr Stoney. Had not been paid.—To Mr Napier : Had no doubt but tho accused was the debtor. His collectors regularly accounted for moneys received. It was very raro that an account, was disputed. Had several collectors.—Philip Lompricro, book-keeper to Mr .Tagger, doposcd that the accused had dealt with Hancock and Co. for draught beer for about two years. Ho proved the debt due to the firm ; it was still unpaid.—Tho matter of tho debt was placed in tho hands of Mr George, solicitor, who deposed that ho appeared for plaintiffs in tho case. Ho knew tho accused. The papers found upon Raflin wero prepared in his oflico (Huglios and Gcorgo). Ho was co#ain that tho accused now in the box was tho person against whom judgment was given, l'risonor called at his oflico a fow days beforo and wished witness to withdraw the caeo, as he would pay him on the Thursday afternoon. Ho did not cnll.— Arhtur Heather, merchant, of Auckland, doposed that ho know tho accused, who was*a publican at Ngungurn, near Wangarei. Witness instituted theso proceedings. Prisoner had dealt with him. He was a creditor of tho accused to i"24"2, the balatieo of account, lie had supplied goods to Rrttin. Ho saw the accused on tho 2Sth September. Ho then promised to pay the account as soon as ho had completed the salo of his hotel and store. ]fo would pay tho noxe morning. He did not call, nor diol he send the money. Met him again on the Ist inst., in Queeu-street. Told him he had not kept his word. Ho made a rambling, unsatisfactory -excuse. Asked him for a cheque on account. He said he would pay him out of the purchase money. Wentto Mr Alexander, defendant's solicitor, to know how matters wero progressing, but could get very little information. Railin got into a rage, and accused him (Mr Heather) of suspecting that ho was going to bolt.

Tho Court was adjourned at 1 o'clock until to-morrow (Saturday) at 10.30, when tho remaining witnesses will bo heard and the other cases taken,
