THE MONARCH INSURANCE DIRECTORS.— THE QUEEN V. TAYLOR AND OTHERS.
In this case an application vras recently made of an important character on the part of a Mr. Mackreth, who was bail for Mr. Joseph Taylor, one of the directors of the Monarch Insurance Company, in £1,000, and who had failed to surrender before the Lord Mayor. The application was to stay the warrant of estreat of this recognisance until next term, or until the case was tried in the Queen's Bench. Mr. Bradley represented the Treasury, and Mr. Kirby, from the office of the City solicitor, the Corporation. Mr. Bradley said the Treasury would leave the matter in the hands of his lordship, and Mr. Kirby said ! the Corporation would' not consent to the application. It appeared that Mr. George Lewis, jun. (Lewis and Lewis), for the prosecutor, had made no objection to the order being made. It was urged that only a suspension of the warrant was asked. Mr. Justice Willes thought he might make an order to stay the warrant. He wished it to be cleai-ly understood that he expressed no wish that Mr. Mackreth should not pay. On the contrary, if the defendant did not appear, then he was bound to pay. His lordship made an order to stay the warrant to recover the amount of bail until next term. Order accordingly.
