POLICE COURT.— Monday.
(Before J. Naughton and L. D. Nathan, Esqs., Justices). DEtTNEENNESS. Ellen Hart, VV. LiivHey, W. Gravy, and John Codd, for a first offence, were each fined ss, or to be imprisoned 24 hours. W. Wilson, on bail, forfeited security. Alex. Anthony arid Chas. Smith, charged with being drunt and disorderly, also forfeited bail. VAGRANCY. Charles Spalding, charged with vagrancy, pleaded sickness, and the case was remanded for a day for enquiry at the gaol as to his health. ASSAULT. Richard Marshall was charged by Richard Marshall, sen., his father, with having, on the 25th June, assaulted him by striking him on the head. Pleaded guilty, and ordered to give security himself in £50 aud two sureties in £lo each to keep the peace for six months. MUNICIPAL POLICE ACT. Philip Kunst was charged with neglecting to keep clean his premises in Durham-street, on 19th July. On promising to forth with put the premises right, fined 5h and costs. DESTITUTE BELIEF OEDIKAKCE. Charles Staeey was charged by Eleanor Stacey -with having deserts, i her on 23rd May, and left her without, any means of support. Mr. Hesketh (for Mr. Joy) for prosecution ; Mr. Wynn for defence. Eleanor Stacey deposed : I am wife of defendant ; he left me on the 23rd of May. We had been married on the 3rd of the same month. We had lived happily togethor during our married life, and I had no cause of complaint. I passed his word to the grocer for supplies by rcy husband's directions ; he had not nil thai I required. My husband returned on 19 h July. He had sent me a pound, which 1 had paid for his passage expenses to Kaipara Iliad to , awn articles and borrow, s.nd then advertised for a situation. 1 was living in Chapel-street when he returned. He is a pensioner, and has ofl'< reii me no support on his retur . He drew £10 5s lOd since, and gave me nothing. We have no .ainily. To Mr. Wynii: The letter ♦.produced, and dated 10th July, is in my handwriting ; so4s that of 19th July. He left me with my concurrence on 23rd May. In Chapel-street i was known as Mrs. Thewhs. The grocer's bill has been paid by my husband. Mr. lies:-el h here withdrew from the case, which was dismissed. ASS IUI.T WTTH INTENT. G-eorge Sampson was charged with assault with intent on Agnes Jackson, on 2nd May, 1869. Mr. Wynu, for prosecution, stated that the case had been withholden on tho promise of the prisoner to leave the district, but he had recent:y returned. In the circumstances he would not press the charge. Case withdrawn. LABCKJS'Y. John ITogan pleaded guilty to having stolen ttvo brooms, value 65., from the shop of S. Brown, Queen-street, on Saturday last. Imprisoned lor one month. MERCIIANT SHIPPING- ACT. W. A. Barrens was charge 1 by John Jacobs master of the Southern Cross, with disobeying orders. Mr. Wynn for complainant. John Jacobs, deposed : 1 am master of the schooner Southern Cross. Def ndaut was cook and steward ; articles produced. Atone of the Solomon Islands 1 hud warned him to look alter the galley against the thieving of the natives. 1 subsequently found him in the chains trading with the natives, and ordered him baok to the galley and he re "used Tho Bench 6em enced the prisoner to four weeks' imprisonment with hard labour. STHALINO TIMBER. George and R. Given were each charged with sti'alin^ a quantity of timber to the value of £25, lh" prop-rty ol VVra. Brimmer. Mr. Hesketh said' that he h<id been requested to take the case up on behalf of Mr. drookfield who was indisposed, and applied for a remand. Mr. Wynn for the prisoners. The Bench remanded the prisoners until tomorrow. Bail accepted. Tho Court then adjourned from 12 o'clock until 2 o'clock.
