VAN DRIVER CHARGED.

SEQUEL TO A FATALITY.

(Per Press Association.) WAIPfrKURAU, Nov. 25

David McGoldrick, aged 21, a, grocer’s assistant, of Haitaitai, Wellington, was charged at the Magistrate’s Court to-day with having been in control of a motor-vehicle while intoxicated, and by an act of omission causing the death of Harold Claude Russell, aged-16.}, grocer’s assistant, of Wellington.

The charge was laid following the arrest of McGoldrick on October 22 after an accident at Whenoahou, near Takapau, when a van driven by accused with Russell as a passenger, left the road at a corner, throwing Russell out at the side.

The original charge of negligent driving was withdrawn on the application of Detective-Sergeant H. Nuttall, of Napier. Mr J. Miller, S.M., was on the Bench, with him Mr F. Adeane, district coroner.

Mr'Scott did not call evidence. McGoldrick pleaded not guilty and was committed to the Supreme Court at Napier, for trial. Bail was allowed in self £250 and one surety of £250. The Coroner’s verdict was that Russell died of a fractured skull sustained in the overturning of a van driven by McGoldrick.
