ILLEGAL LIQUOR.

HINDU STOREKEEPER FINED.

(Special to the “Guardian.'’) AUCKLAND, June 26. A charge* of keeping intoxicating liquor for sale within a proclaimed area against Bhangbanjai Desai, a Hindu storekeeper, of Taharoa, was heard m the Magistrate’s Court at Kawbai before Mr S. L. Paterson, S.M. Inspector Lopdell conducted the prosecution, and Mr Noel Johnston, of Hamilton, appeared for the defence. Constable Carran, of Kawliia, described the raiding of accused’s premises on April 24 and the discovery of 288 pints of liquor, comprising whisky, stout, ale and home-brewed beer, and wine, hidden at the back of the store. The home-brew on analysis showed an alcoholic content varying from 10£ to 22 per cent. Counsel for the defence submitted that there was no evidence of sale, and that the liquor was for private consumption. Accused, in evidence, stated he was a heavy drinker on account of New Zealand’s cold climate.

The Magistrate stated that it was unnecessary to prove actual sale of liquor. The police had discovered large quantities of intoxicants, and the onus lay on the defence to prove disposal. He could not accept defendant’s story. Accused was fined £3O and costs. Security) for appeal was fixed at £6O.
