CURIOUS OMISSION.
QUESTION OF SENTENCE.

ROBBERY, AWTB VIOLENCE

A curious position, has developed at the Criminal Court, when four men were found guilty of robbery with violence. Mr Justice Parsons pointed out that the original Act under which the mem were convicted, which had been amended in the last session of Parliament, provided a maximum penalty of imprisonment for life and a> minimum of three years’ hard labour with a whipping. In the Act as amended, the words “or for any term not less than three years” had been omitted. He therefore had no alternative but to inflict a life sentence. The Crown Prosecutor said the omission of the words quoted was obviously a mistake, which would be brought under the notice of the Government. Mr Justice Parsons undertook to make the necessary recommendations regarding the punishment he would have inflicted had he had discretionary power.
