DR. PEACOCK'S APPEAL,

THE- CONVICTION QUASHED. Per Press Association—Copy right. SYDNEY, December 8.- ---_ The Higli'Court quashed the conviction of Dr. Peacock for the murder of Mrs •Da vies. The Chief Justice found I that although .there was sufficient cir'.cumstantial evidence to show that Mrs Davies was dead, it was insufficient to connect Dr.. Peacock with the death, there being no corroboration of the evidence "given by Pike, who was an accomplice.'...,;' At. the trial, the Judge should have directed the jury to the effect that there was no corroboration of Pike's evidence, and that therefore it would be dangerous to convict. Had the Judge followed that course, the jury must have returned a verdict of not guilty. He would therefore not grant a iiew trial. Mr Justice Barton agreed with the quashing of the conviction, and considered that there should be a new,trial. ; (Received December 9, 12.50 a.m.) Mr Justice O'Connor has agreed that there shoiilcl be a new trial of Dr. Peacock, and the Court has ordered accordingly. .
