F. MAINWARING, Clerk of the Ashburton County Council. Ashburton, 9th August, 1907. Resolved — That, in. pursuance and exercise of tin; powers conferred' upon it by " The Counties Act, 1886," the County Council of the County of Ashburton doth hereby make the following By-laws in respect of Pedlars and Hawkers trading in the County of Ashburton : — In these By-laws the terra "Pedlar" means any person who travels from place to place with goods about his or her person and offering them for sale or selling them. The term "Hawker" means any person who travels with a horse or other beast bearing or drawing burden or with a vehicle (which term shall include a cycle or motor car of an\ description) and goes from place to place or to other persons' houses carrying to sell or exposing for sale any goods, wares, or merchandise ; and shall include any person, not being a licensed auctioneer, who., from a fixed spot in a road, street;;.or other mblic place, offers goods for sale by exposing them to public view, by outcry, or otherwise. 1 It shall not be lawful for any person to carry on the trade or business of a Pedlar or Hawker in" the County of Ashburton without having such license as is hereinafter mentioned, and any Pedlar or Hawker selling, offering, or exposing for sale any goods, wares, or merchandise in the said County shall bo deemed to commit a separate offence upon each day on which he or she shall sell, offer, or expose for sale any goods, wares, or merchandise without having such license as aforesaid ; and the onus of proving that any "oods, wares, or merchandise delivered by any Pedlar or Hawker have been previously ordered by the purchaser thereof shall be upon such Pedlar or Hawker. 2. The Ashburton County Council may, from time to time, at its discretion, grant licenses to persons to carry on the trades or businesses of Pedlars iind Hawkers respectively within the County of Ashburton. Each license shall remain in force for a period not exceeding twelve months, to be stated iv the license, and may be in the form given in the Schedule hereto. The following fees shall be payable for such licenses until the same are altered by Ihp said Council :— For every Pedlar's license for any period not exceeding twelve months—One Pound. For every Hawker's license for any period not exceeding twelve months—One Pound. The Council may, from time to time, by resolution, alter the fees to be paid for such licenses, and every such alteration shall be notified by advertisement in some newspaper published or generally circulated in the said County. The Council may, for reasons which appear to it to be sufficient, revoke any such license during the currency thereof ; ] bul, ill case of revocation, the holder of a license shall be entitled to a refund | of a proportionate part of the fee paid <>y him for the license in respect of Iho | unexpired portion of the term thereof. I 3 A register of all Pedlars' and Hawkers' licenses issued by the said Council shall be kept by the Clerk of the Council or other oificer appointed l.y the Council for the purpose, and •shall be open to the inspection of any person desiring to inspect the same at the Council's Offices, during office hours, upon payment of such fee (if any )as may be fixed by the Council. Nothing in this B^-law contained shall apply to Pedlars or Hawkers who sell only perishable articles of food. Any person who shall commit any breach of these By-laws shall, for every such offence, be liable to a penalty not exceeding Five Pounds. THE SCHEDULE. Ashburton County Council. -..
