' ' Sir, —I have the honor to’report, m reply to Mr. F. B. Passmore’s letter dated January 6th, iBBi, in reference .tflthe legality of the election of three members to the South Rakaia Road Board on January 3rd, inst. First, I

cannot take Mr. Passmore’s time as correct, ,as he did not mention it at the election, and I had no opportunity to verify it. Second, that the time I went by at the election was, to the best of my knowledge and belief, correct. I closed the nomination at 12 o’clock, and then declared the three candidates nominated duly elected as soon as I could write out the necessary forms. Mr. Passmore came into the office almost immediately after 1 had posted the notices. He then never mentioned anything about the lime being incorrect. Third, I was particularly careful that the election was held in strict accordance with the Act. Fourth,

I hold that the election was legal, and Mr. Passmore’s objection thereto is untenable. —1 have, &c., A. Makexg, Returning Officer.
