Retirements under “ The Police Provident Fund Act, 1899.” 10th June, 1902. Constable Lawler, John, No. 592: with a grant of £133 16s. Taking Under-sized Flounders. The following letter from the Marine Department is circulated for general information, and proceedings are to be instituted in all cases when evidence is forthcoming of taking fish under the prescribed size. Should the defence be set up that the fish taken are plaice, not flounders, an adjournment for the production of expert evidence is to be applied for, and an immediate report, giving full particulars, submitted. “ Marine Department, Wellington, 9th June, 1902. “The Commissioner of Police, Wellington. “In April, 1900, the police in Nelson took proceedings against a fisherman for selling a flounder under the minimum size prescribed by the regulations, and the case was dismissed by the Magistrate on the ground that the fish was a plaice, and that the regulations did not make any provision regarding plaice. This Department then obtained a specimen of the fish, and was advised by an expert that it was a flounder, and that plaice are not found south of the Line. The Collector of Customs at Nelson was informed of this advice, and instructed to warn fishermen that if they caught fish below the prescribed size proceedings would be again taken. I have recently been informed that the result of the Nelson case was published in the Press in many parts of the colony, and that the police who saw it hesitate to take proceedings when it is alleged that small flounders which had been taken are plaice. I shall therefore be glad if you will cause the police throughout the colony to be informed of the expert opinion in the matter which this Department obtained. If a case comes before them in which it is advisable to take proceedings, and it is alleged that the fish are plaice, the Department will arrange for expert evidence if advised that it is required. “ George Allport, For Secretary.”
