A LICENSE CANCELLED.

BREACH AT COROMANDEL. At the Magistrate’s Court, Coromandel on Tuesday, before Mr. F. J. Burgess, S.M., John Miller was charged on the information of the police with a breach of the Licensing Act, in absenting himself from the Tererenga Hotel, of which he was the licensee, for a period of more than 14 days, from July 21. Mr. F. P. Burgess appeared for the licensee, and admitted the offence, but asked for leniency, as the breach had been committed through a want of knowledge of the legal position, and the man had to leave because he was not making a living. Inspector Wright, who appeared on behalf of the prosecution, did not ask for a heavy penalty, but urged that the license should be cancelled. His Worship inflicted a fine of 10 s, and costs 7s, and cancelled the license, remarking that it did not necessarily mean that the license would be lost, as an application could be made to the committee for a new license if . a suitable man were available. James Mack (for whom Mr. F. P. Burgess appeared) pleaded guilty to a charge of selling liquor on August 10 at Tererenga a license. Mr. Burgess stated that Mack had been placed in charge of the Tererenga Hotel when the licensee was away. He had carried on under the assumption that as the premises were licensed, and he was acting as barman, he could sell liquor. Inspector Wright did not press for heavy punishment. A conviction was recorded, but no fine imposed.
