vessels, in accordance with the terms of the Order in Council of 11th June, 1863, extending the provisions of " The Foreign Deserters Act, 1852," to the Kingdom of Italy, I caused inquiries to be instituted into the matter, and it was found that the order in question, and all others passed under this Act previous to the year 1865, of which a list is given in the margin,* were not brought under the notice of this department at the time of their being passed, and consequently have never been communicated to the colonies. As these orders affect the whole of Her Majesty's dominions, and as it is of importance that the colonies should therefore be in possession of them, I have now obtained copies, and transmit a set herewith for your information, and for publication in the colony under your government. Enclosure in No. 13. At the Court at Osborne House, Isle of Wight, the 18th clay of August, 1852. Present: The Queen's Most Excellent Majesty in Council. Whereas, by "The Foreign Deserters Act, 1852," it is provided that, whenever it is made to appear to Her Majesty that due facilities are or will be given for recovering and apprehending seamen who desert from British merchant ships in the territories of any Foreign Power, Her Majesty may, by Order in Council stating that such facilities are or will be given dec are that seamen, not being slaves, who desert from merchant ships belonging to a subject of such Power, when within Her Majesty's dominions or the territories of the East India Company, shall be liable to be apprehended and carried on board their respective ships ; and may limit the operation of such order, and may render the operation thereof subject to such conditions and qualifications, if any, as may be deemed expedient: And whereas it hath been made to appear to Her Majesty that due facilities have been oi will be given for recovering and apprehending seamen who desert from British merchant ships in the territories of the Emperor of all the Russias, the King of Sweden and Norway, and the Republic of Peru: .. , , jT ~ ~ -,-, Now, therefore, Her Majesty, by virtue of the powers vested m her by the said Foreign Deserters Act, 1852," and by and with the advice of her Privy Council, is pleased to order and declare, and it is hereby ordered and declared, that, from and after the publication hereof in the London Gazette, seamen, not being slaves, who desert from merchant ships belonging to subjects of any of the three Powers aforesaid, when within Her Majesty's dominions or the territories of the East India Company, shall be liable to he apprehended and carried on board their respective S And the Right Honorable the Lords Commissioners of Her Majesty's Treasury and the Commissioners for the Affairs of India are to give the necessary directions herein accordingly.
