I have the honor to enclose a plan of the north boundary of the Piako Swamp Block, as now surveyed and admitted by the Natives. I shall see Mr. Tole, and have it sent by mail on Friday morning. The area is now reduced to 86,502 acres. Mr. Sinclair to Mr. C. E. Haughton. (Telegram.) Auckland, 13th July, 1876. The area sold is eighty-seven thousand three hundred and twenty-five acres two roods and twenty perches. The area on plan now furnished by Inspector of Surveys for grant gives only eighty-six thousand five hundred and two acres. Memorandum for the Solicitor-General. Under the Order in Council of 12th June, 1876, providing for the sale of the Piako Swamp, will it be competent to the Governor to graut to the purchasers a less area than that described in the Order in Council ? H. A. Atkinson.
Memorandum for the Hon. the Seceetaex for Crown Lands. If the purchaser is willing to take less area than that mentioned in the Order in Council, I see no objection to the grant being made accordingly; but, as the price fixed by the Order in Council is a stated lump sum, I do not think that a proportionate reduction in price can be made. Indeed, the purchaser must distinctly consent to take the lesser area in lieu of the whole area mentioned in the Order in Council, and should give an undertaking that he will not call upon the Crown to fulfil the contract in respect of the difference in area. 18th July, 1876.
