No. 24. The Commissioner of Crown Lands, Auckland, to the Under Secretary for Crown Lands. Sir, — Crown Lands Office, Auckland, 4th November, 1875. I have the honor to forward herewith, for cancellation, a Crown grant in favour of Messrs. Whitaker, Russell, Williamson, Mackelvie, and Aitken, of Lot No. 166, of the Parish of Pepepe. Mr. Whitaker objects to receive this grant in its present form, owing to the omission in the habendum thereof of the words "as tenants in common."' The Solicitor-General, — Should the Government be advised to cancel the grant for the reason assigned ? 16th November, 1875. . C. E. Haitghton. Mr. Hatjghton,— Can you tell me how the grantees purchased ? Did they state in their application that they purchased "as tenants in common"? There is not sufficient information here to enable me to decide. I should like to have copies of the application to purchase, &c. 16th November, 1875. W. S. Reid.
No. 26. The Under Secretary for Crown Lands to the Commissioner of Crown Lands, Auckland. Secretary for Crown Lands Office, Wellington, (Memorandum No. 527.) 18th November, 1875. The Commissioner of Crown Lands at Auckland is informed, in reply to his letter No. 506, of the 4th instant, forwarding a Crown grant in favour of Messrs. Whitaker and others for cancellation on account of Mr. Whitaker's objection to receive the grant without the words " as tenants in common " inserted, that before any decision can be made in this matter, information upon the following points is necessary: —How the grantees purchased? In reference to your memorandum No. 527, of date 18th November ultimo, on the subject of Mr. Whitaker's objection to receive a Crown grant of Lot 166, Pepepe, issued in favour of Mr. Whitaker and others, owing to the omission of the words "as tenants in common," I have the honor to enclose a copy of Mr. Whitaker's application for the land in question, together with a copy of Mr. Sinclair's memorandum thereon.
