DAMAGES SOUGHT

TIMBER COMPANY AFFAIRS NEW ZEALANDERS INVOLVED JUDGMENT BY DEFAULT (United Press Assn. —Elec. Tel. Copyright; (Received Sept. 4, 3.15 p.m.) ADELAIDE, Sept. 4 The assessment of damages was sought in the Supreme Court following a judgment by default for claims totalling £7845 by 35 plaintiffs against the existing Forests and Timber Milling Company, Limited, of Sydney, and Charles Grierson Macindoe, timber merchant, Elsie Evelyn Macindoe (his wife), Stanley James Albert Watkins and Frank Coomber, company managers, and John Derrick Prime, solicitor, all of Auckland. The claims arose out of the selling of bonds by alleged fraudulent misrepresentation or conspiracy to defraud. The sums claimed were those paid for bonds. Actions were discontinued against David Cambie, John McDonald and Malcolm H. McDonald, all of Rotorua, and of Sydney. The applications were heard before the Chief Justice, who said he would order an inquiry before the master for the assessment of damages.
