The case arose as the result of the death of a boy, Eric Charles Hawkins, who died in an amusement parlour when he was shot by a companion who pointed what he thought to be an unloaded rifle at Hawkins and pulled the trigger. The Crown alleged that the proprietor of the parlour had failed to take reasonable precautions, thereby committing the crime of manslaughter.
