MOTOR-OYCLIST FINED NEGLIGENT DRIVING CHARGE “There is no doubt about the defendant's negligence.'’ commented Mr S. L. Paterson S.M.. in the Magistrate's Court, Hamilton, to-day, .when imposing a fine of £5 and costs upon Keith Fensoin, aged 18, motor trimmer, of Claudelands (Mr A. L. Tompkins), for negligent driving in Victoria Street North on January 8. Defendant's motor-cycle knocked down a woman at about 8.50 p.m. Injured when knocked down by the -motor-cycle, Mrs Alice May Codlin, of Hamilton, said in evidence that she was crossing Victoria Street in the evening, when she was knocked down and the motor-cycle ran over her leg. She was admitted to hospital, from which she was discharged three weeks ago. She considered the speed of the machine was excessive and its light was very weak.

Mrs Codlin was seen lying on the road by George William Cochrane, a passenger in a passing car. In evidence he said she was lying about six feet from the kerb. He saw her knocked down and estimated that the motor-cycle was travelling at about 25 miles an hour. Constable Kemp said the motorcycle light was dimmed and fairly weak. The reason for the accident, defendant said, was that he saw Mrs Codlin hesitate when he was twenty yards away. He was under the impression that the pedestrian would gi\e way to him and he proceeded. When she walked on he could not avoid colliding with her. His light carried only 30 yards.
