CHARGE DISMISSED
INTOXICATION ALLEGED DRIVER FINED FOR NEGLIGENCE A charge of driA'ing a motor truck while intoxicated, which avss preferred against Edward John Patrick Malone, aged 60, a stud groom, of Hamilton Mr W. J. King , was dismissed by Mr S. L. Paterson, in the Magistrate's Court, Hamilton, to-day. Pleading guilty fo a further charge of negligent driving, Malone was fined £3 and costs and for driving without a license lie Avas fined 10s. The charges were a sequel to a collision when defendant came off the Fairfield Bridge, turned north and collided with William Young, who was driving in the opposite direction in River Road. The accident occurred at 11 p.m. on January 8. William Young said the accused may not have been intoxicated but liquor could be detected in his breath. Cross-examined, Avitness said Malone was not speeding. Constable A. Valentine said Malone appeared to be under the influence of alcohol when he examined him at the scene of the accident. Malone said he had consumed three bottles after six o’clock. Constable E. J. O'Mahoney, who saw Malone at the police station, said accused appeared to have had liquor but. when he saw him an hour and-a-half after the collision, he did not
think he was intoxicated. Dr. M. A. Stewart said he examined Malone at 12.30 a.m. Accused had obviously had liquor but at the time of the examination, he was not, in the opinion of witness, intoxicated.
