NEGLIGENCE CHARGE

FATALITY AT WHATAWHATA * MAGISTRATE’S COURT HEARING The hearing was commenced in the Magistrate's Court, Hamilton, todav, before Messrs J. Primrose and F. *J. Tattler, J’s.P., of a charge of negligent driving causing death preferred against Ernest Roy Thornton (31 , an employee of the Raglan County Council. Accused is represented by Mr X. S. Johnson and the case for the police is being conducted by Senior-Sergeant G. 11. Lambert. The prosecution arose out of a fatal accident which occurred on the Whatawhata-Hamilton main highway on September 3 last when a car driven by accused collided with a truck driven by Edward Skelton Dobbie, a passenger in the truck, Maurice Desmond Kelly (23), drover, of Frankton, being killed. Dobbie is represented at the hearing by Mr A. L. Tompkins. Evidence along the lines of that given at the inquest into the deatli of Kelly, held at Hamilton on November 30 last, was given by witnesses to-day. (Proceeding.)
