DEATH OF HUSBAND A PLAINTIFF NON-SUITED WE L LIN GTO N, Wednesday Holding that the inference of contributory negligence was irresistible, the Chief Justice, Sir Michael Myers, non-suited in the Supreme Court Mrs Kathleen McAuley who claimed £4OOO general damages for the deatli of her husband, Daniel McAuley, £3l 14s special damages and £SOOO for the deprivation of his normal expectation of life. McAuley was killed on August 28 when the motor-cycle he was riding collided with a motor lorry in the Ngahauranga Gorge. Defendant was William Young, fruiterer and greengrocer, of Johnsonville.
