CAR’S CAPSIZE
FINES FOR NEGLIGENCE. MOTORISTS’ RESPONSIBILITY. COLLISION AT CLAUDELANDS. " This corner is, according to the witnesses, a bad one. Un approaching intersections of this nature motorists have the responsibility of taking greater precautions than usual,” said Mr. S. L. Paterson, S.M., in the Magistrate’s Court, Hamilton, to-day, in imposing fines on Jack Hivett, grocer, of Hamilton, and Sarah Elizabeth Tiddy, of Claudelands, who were charged with negligent driving which resulted in a collision at the corner of Galloway Street and Knighton Road, Claudelands, on May 13. Mrs. Tiddy (Mr. A. H. Powell) was convicted and fined £2 and 15s costs, while her driving license was endorsed until May, 1938. Rivett was fined 10s and 13s costs. The charge was conducted by Senior-Sergeant G. H. Lambert.
Hubert Lush, a labourer, of Coromandel, said that he was walking up Clyde Street on May 13, and, when approaching Galloway Street, he. saw a van and a car approaching the intersection. Both vehicles were travelling at an excessive speed, and neither sounded a horn. The lorry struck the car, which turned over. Witness considered that neither driver was keeping a correct look-out.
Cross-examined witness said that the car\was travelling at about 35 or 40 miles per hour. The driver, Mrs. Tiddy, applied the brakes of ’the car before the impact.
Constable H. M. Kirby said the van approached on the right of the, car. He said the intersection was a dangerous one.
Jack Rivett, one of the defendants, and the driver of the van, said that he was not travelling at more than 20 miles pe hour. He added that the car of the other defendant hit his vehicle, which was swung around. To the senior-sergeant defendant said that he did not see the car of the other defendant until the impact. Defendant said that his van struck the car in the side after being swung around as a result of the impact. Mr. Powell said that Mrs. Tiddy did not see the van approaching owing to poor visibility. The lights of her car were burning. Defendant said that at the time of the impact her four young children were in the car.
