The case was continued to-day in the Sydney Supreme Court in which Henry Edgar Russell, owner of the racing colt Mala, Is suing the Commissioner of Road Transport and Tramways to recover £2OOO damage* owing to injuries to the Colt when It was struck by a tramcar at Randwicl on the morning of the Australian Jockey Club's Derby meeting, Octobei John Gaxieu. official starter for th* club, in giving evidence for the defence said that at the start of the last Derby Mala looked all right and sliovved no signs of lameness. In fact, he settled down well at the barrier. Leslie Fraser, senior steward, said Mala appeared to be a little fretful. He did not appear to be In his usua condition prior to the start of th* Derby but witness did not notice anj soreness or lameness, i The case was again adjourned.
