ACCIDENT SEQUEL
LORRY DRIVER KILLED
FATALITY IN NAYLOR STREET,
CHARGE AGAINST CAR DRIVER,
As a sequel to the fatality on the Intersection of Galloway and Naylor Streets, Hamilton East, on the afternoon of April 13, John Patrick Shivnan, labourer, of Te Kuiti, appeared before Messrs J. E. Tidd and G. W. Hyde, Justices of the Peace, in the Magistrate’s Court, Hamilton, _ this afternoon, charged with negligent driving as to cause the death of Hugh Henderson Gillies.
Accused, who pleaded not guilty, was represented by Mr Colin Taylor. Dr. D. F. Price, who examined deceased, attributed the cause of death to cerebral haemmorhage. The right side of the skull was badly crushed as if deceased had received a severe blow; the right arm was broken as also were several ribs on the right side of the body. These injuries indicated that he was struck on the right side or was thrown heavily against something on his right side. Truck Upside Down. Constable V. C. Naylor said that on April 13 he attended the scene of the accident—the intersection of Naylor and Galloway Streets-—and took measurements and the positions of the respective vehicles. The vehicles concerned were a truck and a five-seater tourer car and both were lying on the northern side of Naylor Street and the north side of the intersection. The truck was completely turned over with the wheels in the air and the front of the vehicle facing in a westerly direction. The car -was at right angles to Galloway Street with the rear of the car towards the footpath. The front of the vehicles was separated by a distance of seven feet, six inches. From the west to east of Naylor Street wheel marks' could be seen for a distance of 40 feet these being made by the truck. For 12 feet they turned sharply to the left as though the truck had suddenly swerved. A detailed plan setting out the point of impact was produced and also photographs of the truck from various angles after the accident. Photographs of the car were also put in.
