FENCE ON FOOTPATH
CHARGE OF OBSTRUCTION
TOWN BOARD AND BUILDER. INFORMATION DISMISSED. (Special to Times-) OTOROHANGA, Wednesday. ‘ Mr P. H. Gosse, secretary and engineer to the Otorohanga Town Hoard, proceeded against George Goldthoipe, in the Police 'Court yesterday for having erected a barricade on the footpath, in Tuhoro Street, opposite where building operations are contemplated, without having first obtained, permission from llie Town Board. Mr H. G. Corbett appeared for the Board and Mr J. F. Trapski for the defendant. It \vas contended, for the defence, that Goldthorpe did not erect, the barrier- It was suggested that his builder, R. G. V. Garrett did so. In evidence Garrett swore that he knew that Goldthorpe did not do the work. On being asked if he had erected the obsruction. Garrett refused to answer, on the grounds that lie might incriminate himself. He refused to say who erected the temporary fence. The case occupied the whole of the afternoon. Mr Trapski contended that Goldthorpe had been hampered in every way by the Town Board, who controlled the Municipal Pictures and did not want an opposition picture theatre in the town. Mr Corbett strongly opposed these remarks. His Board merely required Goldthorpe to conform with the Board's building by-laws, After a mass of evidence had been heard, and the advocates had stated their cases, the Bench adjourned the Court in order to consider the case. Upon resuming, they dismissed the information against Goldthorpe and ordered each party to pay its own costs.
