SEQUEL TO COLLISION.
CHARGE AGAINST MOTORIST. ' A* INFORMATION DISMISSED. The sequel to a severe collision at the corner of O’Neill and Grey Streets, Claudelancjs, in the early hours of the morning of August 6 in which the two motor-cars involved capsized and some passengers were injured took place in the Hamilton Magistrate's Court 'this morning when Cyril Thomas James Glarkin was charged with failing to give way. Mr. W. J. King appeared for the defendant.
A. J. Schneebeli, farmer, of Fuketaha, gave evidence that he was driving along O’Neill Street from Rivet Road towards Grey Street when he collided with defendant’s Car, coming from the direction of Fairfield. Both cars were overturned. His wife received head injuries, necessitating her admission to the hospital, and his son sustained minor injuries. He was not travelling fast and had defendant observed the right-hand rule the accident would never have happened. ■ Defendant, in a statement to the police, said he was practically across the intersection when the rear of his car was struck. A shop on the corner obscured his vision. '
In dismissing the information, Mr. S. L. Paterson, S.M., pointed out that the intersection was an unusual' one and a motorist driving from O’Neill Street to Hukanui Road should make a definite turn to the left into Grey Street before driving into- Hukanui Road. The driver of the other car had failed to take such a course and in his* opinion the right-hand rule did not apply.
