BANKRUPT GARAGE-OWNER INDISCRIMINATE CREDIT. DISCHARGES SUSPENDED. “My client has been brankrupt for over six years and he thinks he should now be given the -opportunity to make a fresh start as soon as possible," stated Mr D. Seymour In the Supreme Court, Hamilton,' this morning, in applying for -a discharge from -bankruptcy on behalf of John Alfred Norman Winger, garage proprietor, of Taumarunui. Counsel explained that bankrupt had been relying to a large extent on financial assistance from his father, who estimated that he was worth £20,000 in 1920. However, he -had lost a good deal of money by speculation and entering into guarantees and the estate realised very little. Winger’s chief fault was that he -gave too much credit to his -customers. Unless there were strong -grounds for refusal bankrupt should be given an -opportunity to make •good, especially in these times. , The Official Assignee (Mr V. R. Crowhurst) -said the Official Assignee at Auckland had accused bankrupt of reckless trading, the giving of indiscriminate credit, and -over-valuation of partnership assets. “The Official Assignee’s report shows that you acted in a thoroughly reckless manner,” stated Air Justice Smith. “It appears to be well founded and the Court must show its disapproval -of this kind of trading.” The discharge was granted subject to suspension for six months. Discharge Suspended. “Bankrupt’s attitude throughout has not -been in the Interests of his creditors,” -observed the Official Assignee, when Mr Seymour applied for a discharge from bankruptcy on behalf of Arthur Arnold Best, driver, of Hamilton. The Assignee said in May, 1931, bankrupt was employed by his brother -on a milk round at 30s a week. The business was then known as Best Bros. In October -of the same year the business was transferred by bankrupt’s brother to bankrupt’s wife, an agreement -having been drawn up by bankrupt and signed by his wife. This arrangement with the wife, submitted Air Crowhurst, did not indicate a desire 'on bankrupt’s part to meet ids liabilities. His Honour agreed and -granted the -discharge subject to six months’ suspension. Discharges Granted. ‘ Discharges from bankruptcy were granted Alfred Beaton, rabbit trapper, Walton; John Maitland Smith, labourer, -of Frankton; James Hamilton Still, contractor, Otorohanga; Elrington Quick, farmer, Taupiri; William John Bowling, machinery agent, Hamilton; Arthur George Tibby, garage proprietor, Taumarunui; Henry Kells, farmer, Putaruru; Arthur Chirney, sharemilker, Plrongia; Charles Leonard William Brown, agent, Hamilton; John Oliver Fruish, grocer, Hamilton.
