SALE OF ELITE BINGEN. COURT ACTION FOR £SO. DUNEDIN, Tuesday. The Magistrate, Mr Bartholomew, gave judgment to-day in the case of Robert Geen, of Oam&ru, against Matthew Henry Dawson, in respect to a sale to the latter of the mare Elite Bingen, the point in dispute being a sum of £SO to he paid to the plaintiff out of the first stakes won. The legal point at issue was the joint interest or “contingency,” and llie Magistrate held that by plaintiff’s signature to the registration form, notifying that his contingency expired on July 31, 1932, lie debarred himself from now alleging to the contrary.
