SUPREME COURT ACTION.
ALLEGED UNDUE INFLUENCE

The granting of probate of the will and codicils of the late George Glover, of Wellington, was opposed before the Chief Justice, Sir Michael Myers, in the Supremo Court to-day by Mrs Grace Adeline Dunn, widow, and Mrs Jane Helen Cowles, on the ground that the testator.lacked testamentary capacity and that he was subjected to undue influence. The testator left surviving him nine children, three daughters and six sons, the daughters .being Mrs Galbraith, the plaintiff in the present case, and Mrs Dunn and Mrs Cowles, the defendants. The testator died in Wellington on July 26, 1932. Records showed that in his lifetime he made a number of different wills.
It was set out in the statement of defence that from December, 1925, until October, 1928, the testator resided alone with Mrs Galbraith, and it was alleged that the execution of the 1928 will and codicils was procured by the undue influence of Mrs Galbraith.
Replying to His Honour, Mr Wiren, counsel for plaintiff, agreed that the case resolved itself into a dispute between three sisters.
Evidence was called with a view to establishing that the will and codicils were properly executed, that the testator was of sound mind, memory and understanding and that he was not coerced by Mrs Galbraith into executing the will.
The hearing will probably last several days.
