MAGISTRATE’S COURT.

A FORTUNATE ESCAPE.

CAR STRUCK BY TRAIN. MOTORIST IN COURT. John Layne experienced a fortunate escape from serious injury recently when his motor-car stalled on the railway crossing in Victoria Street and was struck by a special train from Tauranga. In the Hamilton Magistrate’s Court this morning before Mr Wyvern Wilson, S.M., he pleaded guilty to approaching a railway crossing while the line was not clear. Senior-Sergeant Sweeney explained that defendant in following another car failed to see the crossing-keeper’s signal in time and endeavoured to pull up when his vehicle was right across the line. His engine had stalled and the approaching train had struck the vehicle carrying it for some distance. The accident had occurred at about 1.40 p.m. In ordering defendant to pay the costs of the prosecution His Worship remarked that it was not apparently a bad case. Cut the Corner. Charged with cutting the corner off London and Barton Streets, Percy Coley was fined 40s with costs 10s in the Hamilton Magistrate’s Court this morning before Mr Wyvern Wilson, S.M. The Senior-Sergeant explained that as a result of defendant s action he had collided with a cyclist. Mr Tompkins pointed out that his client had cut the corner of the intersection in question to avoid the cyclist who had been pursuing an erratic course. No Efficient Silencer. Failure to have an efficient silencer attached to his motor-cycle cost Harold Thurston Stevens, 10s and costs for a similar amount. Constable Brown told His Worship that the noise of defendant’s machine could be heard all over Hamilton.
