CHARGE OF MURDER.

AFFRAY IN AUCKLAND. MIDDLE-AGED LABOURER KILLED. (By Telegraph.—Press Association.) AUCKLAND, Thursday. In the Police Court George Caffrey, aged 34, a labourer, was charged that on August 2 he murdered Thomas Levy, a middle-aged labourer, employed by the Fletcher Construction Company. “I Want Cole.” Margaret Langton said that she and her husband were sitting in thcfiir front room on the evening of the tragedy. About 6.25 there was a noise outside, and witness went out, followed by her husband. Her husband struck a light and said, “It is you, Caffrey.” The man her husband had called Caffrey had a bag of potatoes over his shoulder. When spoken to he replied, “I do not want your potatoes; I want Cole; I am going to kill that to-night. He sleeps in that back room of your house." Witness said, “You will do no killing here,” and told Caffrey that Cole had left her house ten days previously, and was living at No. 119. He then went away. Statement by Accused. Detective Sneddon said that when accused was taken to the police station he said to witness: “I will tell you all about it; I know what you want me for.” In a written statement read by witness, accused said that he went to 119, Nelson Street, to sec Cole. The door was opened by a man he did not know, who told him to go away. There was then a scuffle, and suddenly the man cried out about blood flowing from him. Accused said that he had nothing in his hands at the time and did not know how the man was injured. He was accopmanicd by a friend, Patrick Byrne, but he did not see him with any weapon. Accused added that he assisted deceased into a room He said that he had had a few drinks during the afternoon and evening, but he remembered clearly what had happened. Accused pleaded not guilty and was committed to the Supreme Court for trial.
