APPEAL COURT.
WAIKATO ACTION. CAMBRIDGE DAIRY CO. SUED. " CASE STRUCK OUT. (By Telegraph.—Press Association.} WELLINGTON, Thursday. The Appeal Court to-day had before it the case of the Official Asignee of the estate of 11. .E. Porritt, farmer, of Pukeroro, against Elizabeth D. Porritt and the Cambridge Co-operative Dairy Company, a claim for £54 6. The case arose out of Porritt's insolvency and a bill-ot'-sale for £IOO given by him to his wife.
Mr Walts appeared for the appellant, and Messrs Northcroft and Tompkins for respondents. Mr Northcroft applied to have the case struck out, on the ground of want of prosecution. Afler argument the Court struck it out, holding that (he required notice of appeal had not been given within 28 days, as required upon the interlocutory judgment, Fifty guineas costs were allowed to respondents.
