MAGISTRATE’S COURT.

MATAIWATA SITTING. At the usual monthly sitting of the Court Mr F. W. Platts, S.M., presided. Matrimonial Troubles. Elizabeth A. Dillon, proceeded against Stanley E. Dillon, praying that a maintenance and separation order be granted against him on the grounds that he had failed to provide her with adequate maintenance and that he had been guilty of persistent cruelty. in her evidence plaintiff stated that she was married in February, 1922, and had one child. Stic detailed acts of cruelty committed by defendant. Plaintiff had been residing with her husband at Mamaku for 4£ years, and left him in April last. Defendant denied tl*e allegations. Evidence on defendant’s behalf was given by Thos. Broderick, pensioner, Muniuku, who said that although the couple had been, living in his house for 12 months he bad not seen any of the alleged acts committed. His Worship said that it appeared from Dillon’s evidence that there was a bitter feeling between himself and his wife. He considered that the charges of cruelty were proved, and ordered that a separation order be made, defendant to pay Mrs Dillon 20s per week, and 15s per week for the child, the wife to have custody of the latter. Motor Collision. Clifford G. Dawson v. John G. R. Hicks, claim £3O 4s Gd, for damage, doctor’s expenses, loss of time, etc., as u result of plaintiff, whilst riding a motor bicycle on the Waharoa Road, colliding with defendant’s bread van on .March 11 last. Defendant counterclaimed for £SO Ss sd, comprising damage Lo van £3l 8s sd; loss of time on van £9, and general damages £lO. Plaintiff also alleged negligence. The defence was a denial of negligence, defendant stating that plaintiff was guilty of the same, as he was corning down the wrong side of the road at a great rate, without any lights. Defendant had an electric torch tied to (he side of his van on the driving side. His Worship said that lie would take time to go through the evidence and would reserve his decision. Civil Cases. Judgment for plaintiff was given in the following civil cases:—: —Wm. Gale v. F. W. Bowers, £1 8s; J. D. Bryce v. Gilleti Tai, £1 14s 9d; A. M. Fusscy v. S. Ellery, 17s (3d only. In the defended civil case, E. C. Young v. T. \V. Forrest, judgment for plaintiff was given, for £3 3s. Judgment Summons: W. E. Andor(on was ordered to pay Ihe Farmers’ , Auctioneering Go £5 per monlh on a debt of £2l 7s Od, in default 14 days’ imprisonment.
