A GUARANTEE CASE.
IMPORTANT JUDGMENT.
INVERCARGILL, Tuesday
An important judgment was delivered by the magistrate, Mr. Cruieksha,nk, in a guarantee case to-day. The .treasurer of the Waikiwi football club was short in his funds, and under pressure his farther guaranteed to pay £72 in order to save publicity. The club sued for the amount. The magistrate said the law was clear that agreements for the purpose of stilling a criminal prosecution arc void, as tending to obstruct the course of public justice. Where securities are obtained from relatives to cover amount embezzled such securities have to be set aside on the grounds that they were obtained by improper pressure and duress, and also as being agreements to stifle a prosecution. A threat to prosecute is not illegal, and it is quite lawful to take security from a debtor. If tiie son had given a bond it would have been binding on him. Judgment was given for the defendant.
