NOT GUILTY OF ASSAULT. ;Bv Telegraph—Press Association.) AUCKLAND, Tuesday. At the Supreme Court the jury found Louis Le Brun not guilty on a charge of assault on Mrs Alice Emery, the parties being vaudeville artists. Mrs Emery was, injured, she alleged, by a blow struck b\ the accused at Fuller's Opera House on November 24. The defence was that the injuries were caused by falling. PRISONERS AND COUNSEL MISSING. AN UNUSUAL PROCEDURE. CHRISTCIIURCH, Monday. Several prisoners who had been committed for sentence at the Supreme Court were missing when called upon this morning. One prisoner was not brought up by the police and another, who was at large but not on bail, failed to appear. A third prisoner was also missing, and Mr Justice Ilerdman sarcastically suggested that the registrar should also call on Donald Pugh, who disappeared while on probationary bail and had not yet been arrested. His Honor *aid that the prisoners should have been there, but apparently the Court was being asked lo study their convenience. In another case, where counsel for the defence was not present, his Honor ordered the trial to proceed. Archie Athol Jacobs, a native of the Chatham Islands, pleaded guilty to a charge of unlawfully ami carnally knowing a girl, also a native. Counsel foi prisoner said he was engaged to the girl at the time of the offence, and was prepared to marry her. The girl also was willing. He asked that prisoner be placed on probation so that an application might lie made to the Court for leave for the marriage of the couple. Mr Justice Herdman said lie proposed to take an unusual course. Prisoner was liable to five years' imprisonment, but in view of the circumstances he would be admitted to probation for two years arid would have to pay £SO, the costs of the prosecution.
