WITHIN THE DOMINION
A QUESTION OF RESIDENCE. By Telegraph—Press Association. CHRISTCHURCH, Friday. At the Supreme Court Marcus Leslie Mullins, a commercial traveller, applied to be declared not a resident in New Zealand within the meaning of the Military Service Act. Plaintiff gav; evidence of his arrival in New Zealand in October in 1915. Soon after he obtained employment and only lost it through circumstances connected with the war. On the advice of a doctor he came to New Zealand in the interests of his wife's health, and not possessing means, sought employment here. Mr Raymond, for the Attorney-Gea-eral, urged that it would lie dangerous for the Court to give r. definition of residence, which might later involve a man working in and enjoying the privileges of the country and who was not. in the position of a tourist. Mr Justice Herdman said that it was clear that plaintiff might escape service either as an English or New Zealand resident owing to circumstance-. Judgment was reserved.
