Defendant claimed he was not liable for tho amount claimed principally on the ground that he had boon resident within the colony for the period required by the act, and that if Robert Curling lnd been resident out of or absent from tho colony for a period of thrte y&irs, still was not liable to the tax as the act only applied to such persons as had been absent from or resident out of tho colony for a period of three years, and had not left an agent t«> represent the.in in the colony. Defendant further said that he did not admit that Curling had been nbsenl from the colony for the sp.ico of threo year.-. After evidenco had been taken and argument heard, judgment was given for plaintilf with £3 13s cost. JJetendaut gave notice of appeal,
