Second Day, April 18th.

George Mason v. G. B. Beere. — Mr Hay for the plaintiff, Mr E. Hesketh instructed by Messrs Whitaker & O't^eill for defendant. This was a claim ior £58 8s 9d for nursery stock snpplied and planted. A net off was pleaded amounting to .£2O 9s Id. The balance of claim was disputed with Ihe exception of .£3 15s 2d paid into Court. Six witnesses were examined and counsel addressed the Court. Judgment for plaintiff, £37 14s 8d with' costs, £10 Is. J. Hamilton v. J. O'Brien, — Mr Hesketh for plaintiff, and Mr Hay for defendant. Claim £25 10s for sheep sold and delivered. Defendant pleaded not indebted and that he was the agent of another, which the plaintiff well knew at the time he purchased the sheep. Three witnesses were examined. Judgment for plaintiff for full amount and costs, £6 Is. .
