Tuesday, September 24, 1872. (Before W. N. Searancke, Esq., R.M.; P. Leslie, Esq., J. Seddons, Esq.,and Captain Steele, Justices of tlie Peace.) CitiTj. Cases. titzgera.ld v. leslie. Claim, £17, for "wages. Plaintiff being sworn, deposed: That lie claimed the above amount for wages due to him at the rate of ss. per diem, less the amount to be deducted for wet days, the number of which he did not know as he had' kept no account of them, but that Mr Leslie would be able to inform the Court of the number. Mr Leslie stated that the plaintiff had been in his employment for about two years. The agreement between them was that lie should receive at the rate of ss. for every day he worked. The plaintiff asked for contract work on the 18th inst., and as lie could not get any was impertinant and struck work. He told him to work on to the end of the week, as a week's notice would be required. He refused. Defendant therefore contended that the man was only entitled to receive wages up to Saturday, the 14th inst., or £15 15s. —the amount tendered to plaintiff, but refused. The bench were of opinion that a week's notice was required, and did not consider that the plaintiff was entitled to wages for the portion of the week he had worked. Judgment for £15 15s. Plaintiff to pay costs, as the sum for which judgment was given had been tendered to him. CUJniIXGS V. BEALE. Claim £20, being amount of alleged damages sustained by plaintiff by the non-fulfilment of certain covenants in a lease. On the-advice of the bench the case was withdrawn, litigants having agreed to refer the case to arbitiation, one for each party, and they to appoint a referee. The names of the arbitrators to be submitted to the Resident Magistrate for approval.
