RESIDENT MAGISTRATE'S COURT
Wednesday, 15th January. (Before J. N. Wood, Esq., E.M.) BREACH OE MUNICIPAL BYE-LAWS. R. Guppies Mas charged with furious driving on Bth January. The Inspector of Nuisances deposed to seeiug Guppies driving at a furious pace at the upper eud of Palmerston street on the date named, to the emminent danger of Her Majesty’s lieges. He appeared to be trying a race with a man named Hay, who had also been summoned on a similar charge.—E. Guppies said the horse was not going at the rate of more than five miles an hour. The fact was the horse could not trot, and always travelled at a “butcher’s canter.”—The Magistrate said ho would postpone his decision until the case agtduat Hay was heard next week. Defendant preferred to plead guilty as postponing decision would necessitate his attendance at Court another day.—Fined 5s and costs. E. R. Ford was fined 5s and costs for blasting with dynamite within town boundary, after beivi" warned not to do.so by the Municipal Council. ° CIVIL CASES. Hogg and Barry v. Fitzgerald Bros.—Tho Magistrate now gave decision in this case beard at Orepuki on 18th October. Plaintiff’s claimed £47 lls, in consequence of wilful destruction of their fluming by defendants. The Magistrate reviewed the evidence at some length, k and characterised the case as more fit for tho
criminal than the civil court. He had little doubt as to where the timber came from that repaired Fitzgerald’s flume. Judgment was given for plaintiff for £2O and costs.
