William Sievers. — This was an action to recover the sum of .£2 10s., amount i of highway rate on 100 acres of land situate at I Makara, near Wellington. Defendant disputed the claim on tho ground that there is no Board of Wardens in existence, and that consequently the rate is illegal. The Resident Magistrate having expressed an opinion that- the Collector and Treasurer (the plaintiff) not having given security as required by the Act. he, plaintiff, had no legal status.
