October. lSst^ nu^siadefnelwjj§M^ ij^Hiet Mttnn, formerly of VVellihgttft^*^ tlffi*"' Province' bf' Wellington, and Colony of NeV^etHand, hut then of Napier, in the District' of Ahuriri, in the same "Province, Licensed Victualler, of the first part, and James Meliss, Stuart and John Gibson Kinross, both of Wellington aforesaid, merchants, of the second part, and the several other persons whose names and seals were thereunto subscribed dud set, beiug severally creditors of the said Daniel Munn of third part. After reciting a certnin Deed bearing date the said Bth day of October, 1858, and made between the said Daniel Munn of the one part, and the said James Meliss Stuart and John Gibson Kinross of the other part, being a Conveyance by the said Dauiel Munn to the said James Meliss Stuart and John Gibson Kinross, their heirs, executors, administrators, and assigns, of t_U' the real and leasehold -".states of the said Daniel Munn. It was witnessed that for the considerations in the said Deed of Assiynmentnientioned, the said Daniel Munn did thereby assign and set over unto the said James Melis3 Stuart and John Gibson Kinross, their executors, administrators, and assigns, all and every the Stock in Tra'le, Goods, Wares, and Merchandise, Household Furniture, Plate, linen, Ch'na, Books of Account, Book aud other Debts, sum and sums of Money, and all Horses, Cattle, Sheep, Carts, Drnys, Whaleboats, and other Boats, and all other the personal Estate and Effects whatsoever ard wheresoever, of him the said Daniel Munn, in possession, reversion, expectancy, or otherwise, (except the wearing appnrel ofthe said Daniel Munn, aud of his wife and children,) upon certain Trusts in the said Deed mentioned, and amongst otiier Trusts, upon Trust that if the said Daniel Munn should not ou the first day of October, 1859, pay the several debts in the said Deed of Assignment mentioned and thereby secured, that then tire said James Meliss Stuart and John Gibson Kinross, aud the survivor of them, do and shall take possession of, call in, collect, and receive, ali and singular, the real and personal Estates of the said Dattiel Mmm, and sell the j same ns iv the said Deed of Assignment mentioned. Aud we hereby camion and warn nil persons from dealing with the said Dauiel Munn, in respect of any of the said real aud personal Estates of tke said Daniel Munn, so conveyed aud assigned to us. Stuart, Kinross, & Co., dated the eighth day of October, 1858, we hereby certify that there is no foundation for the statements made therein, aud that Messrs.
