May 10,1859. ■IV/E HKREBY "GIVI-: NOTICE, that by Deed V » of Assignment dated the «lb day of October. 18.18, and made between Daniel Muim, formerly of Wellington, in iho Province of Wellington, and Colony of New Zealand, but then of Nnpier, in ihe District of Aliuiiri, in the i-anie Province, Licensed Victualler, of the first part, anil James ?.leliss Smart auci John Gibson Kinros.i. both of Wellington aforesaid, niurebcuts, of tbe second part, and the several other per-oils whose names and seals were tbetcunto subscribed ami set, being severally creditors of the said Daniel Mann of third ] ait. It was witnessed that for the considerations in the said Deed of Assisumeiilnieiilioued, the said Daniel Munn did thereby assign and set over unto the said Jainos Melisj Stuart aud John Gibson Kinross, tbeir executors, administrators, and assigns, all and evcij the Stock in Trade, Goods, Wares, nnd Merchandise, Household Fmiiituie, Plate, linen, China, Books of Account, Book and other Debts, sum and sums of Honey, und all Horses, Cattle, Sheep, dirts, Drays, Whaleboats, aud other Boats, and all otber the personal Estate and Effects whatsoever ard wheresoever, of him the said Daniel Munn, iv possession reversion, expectancy, or otherwise, (except the weaiing apparel of ibc said Daniel Munn, and of his wife and children,) upon -eriaiu Trusts iv tbe said Deed nient'oned, and amongst other Trusts, upon Trust that if the said Daniel Muim should not on tbe first day of October, 3519, pay the several debts in tbe said Deed of Assignment mentioned nnd thereby secured, that then the saia •lames Meliss Stuart and John Gibson Kinross, and the survivor of tlietn, do and shall take possession of, call in, collect, and receive, all nnd singular, the real and personal Estates of the said Daniel Munn, and sell the same as in the said Deed of Assignment mentioned. And we hereby camion and warn all persons from dealing with the said Daniel Munn, hi respect of any of ihe said real aud personal Estates of the enid Daiiiel Munn, so conveyed aud assigned lo us.
