RESIDENT MAGISTRATES COURT.
BEFORE STEPHEN CAItKEEK, ESQ., J. r., AND GEOnGE MOORE, ESQ-, J. P. Saturday, llth June, 1859. Wood, Gaffny, Cullen, Kelly, Darleg and Shields, were charged with having on the 4th day of April last, escaped from the Wellington Gaol, they being prisoners, under sentence at tbe time. Mr. Brandon, appeared as Provincial Prosecutor.. From the evidence of Richard Mills, Warden of the Gaol, and others, it appeared tint the six prisoners with two others, who are still at large, were returning to their dinner, and when they arrived at the gaol door, they rushed upon all tlie officers in the gaol, ill-used and knocked down Slight the turnkey, and fired a gun at him, and after having been iv possession of the gaol about 20 minutes, and taking such things as were likely to be useful to them, also several guns and ammunition, they then proceeded to knock off their irons, having first secured the officers in the gaol by locking them up in the cells. Mrs. Mills said, Kelly jumped the gaol fence and called to Abraham who gave chase after Kelly—Kelly picked up a stone, and Abraham closed with Kelly aud threw him violently upon the ground. Gafeny came up with three others, Gafeny having a pistol in his hand, Mrs. Mills begged of him not to use it, he seized tbe tight arm of Mrs. Mills and said, I will not hurt you, but I will shoot the Maori, (Abvaham) she snid pray don't, Gafeny replied come and see me shoot that ( -) Maori. M!rs. Mills ran into the house and immediately she heard the report of a pistol; I thought Abraham was shot, for I called out to him and he did not answer. A detachment of the 65th regt. came up, lint was too late to render any assistance. All the prisoners were committed to take their trial ut the next sittings of the Supreme Court which will bo held to-day. Gafeny and Cullen were again put into the box, and tried for the Capital offence, for shooting at Slight and the Native Abraham, After evidence of several witnesses they were fully committed to take their trial for wilful murder, at the next sittings of tbe Supreme Court, and witnesses bound over to prosecute.
